I think people just assume that his name must be Guerin because it's Michael's last name. Most probably don't give it much thought I imagine.

Michael did not only live with Hank so I'd assume that his name came from his first foster family.

So how many families did he have?

Doesnt he say (think it was independence day) that Hank was all he knew???

It's actually up in the air as in I Married An Alien the social worker mentions that she got a call from "them" yet we never hear of Michael living with more than Hank. So either that's continuity problems or they just never elaborated on the issue. I doubt that Michael only lived with Hank especially when the social worker knew of Hank's drinking problems.

foster children do not take the name of their foster family. He may just have been given a name by a social worker just as he was given the first name. Or Jason Katims and co used the name given by Melinda Metz and nobody ever bothered to come up with an explanation of it's origins.
