So glad to see this story restored..........we have quite a mystery going here.
At least we know that Tess is dead.......
But there's so much else to find out and I can't wait.
It appears Max and Liz are still married......

Great Chapter!!!! Please please please please please please please please please please come back with more really really really really soon? I can't wait to find out what will happen when Max and Michael get to the police station. And what will happen when Liz goes home. So glad Michael was called. Cool Michael is trying to get Max. Wow Liz is pregnant! Is Max the father? Did Liz really kill Tess? Will Liz have her baby in prison? Will Liz lose the baby? Will Max and Liz talk? Will Max and Liz be able to get past it? Will Max, Liz, baby be a happy family? Will Max and Liz be a loving married couple? Will Michael be able to get Liz out on bail? Will Liz have to stay in jail till the trail? Will Liz be free? Sorry for all the questions I was just wondering. Please please please please please please please please please please come back and post more really really really really soon? I can't wait to find out what will happen next.

A/N: Thanks for all the wonderful feedback, looks like because I'm still new they had to post everything and approve it so I apologize for any confusion!
All your questions will be answered soon. I hope you enjoy ch 2!

Ch. 2

We get to the police station in less than 10 minutes but it seemed like hours thanks to Michaels cruiser. I immediately run up to the desk, “I’m here on behalf of Elizabeth Evans.” I tell the deputy.

“Mr. Evans, you know very well you can’t see your wife tonight.” I hear the voice telling me. “Gurien, I told you to stay home and leave this to us.” He says shifting the focus to Michael now.

Michael nods, “Yes sir, I understand, but she’s my sister.”

“That doesn’t mean you can interfere with a murder case especially when it’s family involved son.” He explains.

I take a step forward interrupting the conversation between the two, “Sheriff Valenti, I’m not here as Mrs. Evans husband, I’m here as her attorney.” I look around to see deputies looking at me and Michael about to lose it at any minute, “She has the right to an attorney to be there during booking.”

Valenti nods, “Yes that’s true, but you are also her husband and a material witness. The girl she is accused of murdering…I understand was your mistress?” He asks me boldly.

I glare at him, feeling ashamed inside but angered on the outside for Valenti even doubting Liz’s innocence. “It was one night and that’s a matter between a husband and his wife.” I grit out calmly through my teeth. I regain my composure and continue, “Mrs. Evans has no criminal background and outstanding ties to this community. She has the right to counsel.” I demand of him firmly.

“Very well, Mr. Evans. I must advise you that there will be no bail hearing until tomorrow morning. I’ll give you 15 minutes.” I nod thanking him. “Gurien in my office.” He yells at Michael.

“Tell Liz…” He chokes out but can’t finish. He looks at me a moment before heading back to Valenti’s office.

I nod before getting led by a deputy to an interview room. I pull the chair out thinking I want to sit down but I can’t manage to sit still long enough. How could they believe Liz could do such a thing? I hear the door creak open. “What are you doing here?” I hear her whisper. I see her delicate features even though she won’t look at me. “Where’s Michael?” She asks.

“Michael is in with the Sheriff, he said to tell you he loves you and he’ll see you in the morning.” I explain to her. “Are you okay?” Stupid question, I know. I want so badly to reach out and hold her, touch her, but I know she would rebuff.

She slowly looks up at me, her eyes bloodshot from crying, “Why are you here?” Is all she asks. I gesture to the chair but she refuses. “I’m in here because of your stupid mistake!” She yells at me, “Because you couldn’t keep it in your pants!”

I take her yelling without flinching. I deserve it, all of it, if I could I’d switch spots with her in an instant. Better yet, I’d go back and take away that entire day that changed everything. “I can’t get you out tonight on bail but there will be a hearing to set bail tomorrow morning.” I see her shoulders start to shake as she finally sits down still not looking at me, I continue to explain what’s to come, “I plan on getting you released so we can figure out how this all happened.” I tell her.

She laughs sarcastically, “I murdered your mistress, didn’t you hear?”

“I don’t believe that Liz. I know you’re upset about Tess and I. You had every right to be, but I also know you would never hurt anybody. You would never put your life in jeopardy like that knowing your going to be a mother.” I see her flinch at my words. “I’m going to get you and our baby out of here and prove you’re innocent.”

She leans forward, “I don’t want your help Max Evans. You ruined my life, you’ve done your part.” She spats at me. “The last time I ended up trusting you, we were married and you cheated on me. Now, I’m expected to trust you with something like this?”

“I don’t care if you want my help or not Liz. I’m your attorney. Michael can’t help you with this. Sheriff Valenti won’t allow it, but I can still be your attorney even if you hate me and that’s probably for the best. Right now you need someone in your corner to defend you because the evidence is against you and as far as I’m concerned you don’t have many people in your corner.” I tell her bluntly.

“So you think I did it then? Don’t you, you think I killed that girl?” She mumbled. I take a risk and lay my hand on top of hers causing her to look up at me, I see her trying to hold back the tears.

I shake my head, “Not for a minute Liz. Not for one second do I believe you killed anyone.”

“Well, that makes one of us.” She stated. “I don’t know what happened, I can’t remember a thing.” She starts to explain causing me to panic.

I interrupt her, “Liz, don’t say another word. Wait until we get you out of here and then we’ll talk. Don’t talk to anyone without me present, understand?” I urge her, basically begging her.

“I understand.”

“Ho-How’s the baby?” I ask cautiously.

She shrugs, “I’m not sure, I’m supposed to have an appointment tomorrow but doesn’t look like that’s going to happen.” She touches her stomach, “I can’t lose this baby too.” She cries.

“You’re not going to lose anything Liz, I swear to you. Everything is going to be okay.” I promise her. I hear a knock on the two-way mirror. The deputy comes back in and pulls Liz up from the chair. “Liz, not a word. I’ll get you out tomorrow.” She nods before being escorted away.

I walk out to the hallway and come face to face with Michael, “How is she?” He asks me.

“About as good as can be expected. She can’t remember anything.” I tell him. He nods, “What did the sheriff say?”

“He told me to take a few weeks off until things settled but that the evidence…Max it proves she’s guilty, no doubt about it. Her fingerprints were on the weapon, the blood, no signs of force entry or self defense.” He explains dreadfully making my heart sink, “They did a drug test but nothing came up. He said it’s a pretty open and shut case but I refuse to believe my sister is a murderer!” He cried out.

I swallow back the urge to yell, scream, cry; hell I don’t know. She would never hurt anyone, it’s not possible like Michael said, she’s no killer. “Oh but she is…” I hear someone say behind me. “Mr. Evans, surprised to see you here.”

I smirk, arms crossed in front of me as I lean against the wall. I play it cool so not to tip our hat that we are worried, I feel Michael glaring at him and sizing him up ready to pounce. “And what do you mean by that Rodriguez?”

He laughs as he sets his briefcase down to adjust his tie in the mirror, “Like Detective Gurien said, it’s an open and shut case. Your wife is a cold blooded murderer….” I have to stop Michael from attacking the district attorney, I just keep a stoic face, “An innocent woman was murdered in cold blood in your house. One I might add you had an affair with. Wouldn’t you say that’s motive Evans?”

I resist the urge to punch the smug look off his face, “Listen Jesse, my wife would never harm anyone and we plan on proving just that.”

“I look forward to hearing your defense but I have a feeling this case will be very easy to convict.” He starts down the hallway towards the evidence room before he reaches the end of the hall he turns around and says, “Oh and don’t forget to tell your dear sister Isabel I surely do miss her at the firm.” He laughs as he walks away.

I shake my head turning my attention to Michael, “What Isabel ever saw in that jack ass I’ll never know. I can’t believe she almost married that guy!”

Michael chuckles, “Lucky for us she joined the Whittman’s Law Group and fall in love with the partner there.”

“Yea I suppose.” I said exhausted.

“We better go Max.” I hear Michael tell me, “Liz’s arraignment is set for 9 am tomorrow. Are you going to able to afford the bail?” I nod, “I better be heading home, I don’t know what I’m going to say to Maria…or my folks.” He says as it hits him. “Do you want to just come back to our place?”

I shake my head, “Thanks but I could just use a ride home, I need to get prepped for tomorrow but let’s not call your folks yet.” I tell him, “Let’s get her bailed out tomorrow first and go from there.” He nods and we head to the car. “She didn’t do this Michael.”

“I know she didn’t.” He tells me without skipping a beat. “But if she didn’t, who did?” He asks aloud.

I shake my head, “That’s what I’m going to figure out.”
There's no point going back to yesterday because I was a different person then...

So Tess is dead. But there is no way that Liz did it. Someone is framing her.

I agree with Roswelllostcause. But who would be framing Liz for killing Tess though???????

See there are more question than answers. Hoping Michael and Max can get Liz and go home.

At this point, this appears to be an impossible situation for Liz.
Why can't Liz remember what happened?
So many unanswered questions..........

A/N: Thanks again for all the wonderful feedback from you faithful readers. I see there are lots of questions, all of which will be answered soon, I promise....Hopefully you all enjoy this chapter just as much as the others.

Ch. 3

I straighten my tie as I head towards the court room. I already see Michael and Maria sitting outside waiting to be seated. I cautiously approach them, “How are you two holding up?” I ask hesitantly.

Maria’s head jerks up, her eyes were bloodshot from crying, “This is your fault. My best friend is being accused of murder because of you and your damn mistress!” She yells causing it to echo three times louder.

“Maria…this isn’t helping Liz.” Michael says standing up trying to soothe her, “We both know this isn’t Max’s fault.” He pauses for a moment, “Completely.”

I roll my eyes, “I know you want to blame me, I don’t blame you for wanting to, I blame myself too.” I tell her, “But even if Liz doesn’t remember, I know she wouldn’t have killed Tess.”

“And just how do you expect to prove that?” Maria demands.

“We’re in for a fight. She’s had no criminal background, excellent ties to the community, runs a successful business here locally. I know she’ll be released today. Then we have start from there.” I explain to them both, “The only concern I have is the D.A. is Jesse Rodriguez and due to his past with the Evans family, I’d say he’s out for blood. This is more personal for him.”

“Great.” Michael states sarcastically, “Did you call Isabel and Alex? Maybe they can help on the case?”

Max shakes his head, “Alex can, but Isabel can’t due to her past with Jesse. I had to fight to stay on this case and the only way I was able to stay her attorney was if I agreed to have a co-counsel.” I tell them. “They will be here first thing this evening.”

“Well, let’s go get our Lizzie out of there and back home.” Maria says holding Michaels hand. I lead the way in telling them where to sit. I see the prisoners escorted in and it takes everything I have not to run up to her and just hold her in my arms.

“All rise!” I hear the bailiff yell. I go through the motions of the court room waiting for it to be our turn. “Case number 543789, people vs Elizabeth Anne Parker Evans. How does the party plead?” The judge asks.

Liz looks up at me fearfully, I nod to assure her, “Not guilty.” She says calmly.

“People request 150,000$ in bail your honor.” Jesse states, “Client is accused of killing someone in cold blood, in her own home.”

I shake my head, “Your honor, Mrs. Evans has excellent ties to the community, no reason she is a flight risk when she has a successful business here locally, all her family and friends are here, not to mention she looks forward to proving her innocence to everyone.” I add looking directly at Jesse. He smirks at me, “We ask your honor that she be released into the custody of either myself or her brother, who might I add is a decorated detective with the Roswell Police.”

The judge looks through the papers, “Very well, Mr. Evans. She is released into the care of Detective Gurien and yourself. I expect her to be at trial.” He orders.

I nod, “She will be, promised your honor. Thank you.”

“That’s it? I can go home now?” Liz as the bailiff walks up to her.

I look at her and smile, “It’s a small win but a win for now. I have to go sign some documents they should bring you down shortly.” I explain to her.

“Thank you Max.” She says and I nod. I see her lean over and hug Maria and Michael before she gets escorted to the back.

Michael looks at me as I’m closing up my brief case, “Now what?”

“Now we bring her home, right Max?” Maria asks concerned. I nod, “Good, she probably is going to be starved, probably wants a nice hot bath…” Maria starts rambling walking out of the court room.

“I meant how are we going to prove she’s innocent Maxwell?” He asks me.

“I’m not allowed at the crime scene and neither are you, but Alex will be and once he gets in he’s going to reexamine the scene. See if something was missed. Right now I need you to try to get Liz to remember anything about that day and night.” I tell him, he nods, “And I need to do a little digging into Tess’s background. If I recall correctly she mentioned something about a sister but didn’t say where she was.”

“A sister?” Michael questioned, “What does she have to do with any of this?”

“It might give me a little insight on Tess’s past, all I know is that she apparently was moved from one foster home to another with her sister. That she went to Harvard Law….” I start telling him but Michael stops me.

“You two were obviously close.” He states sarcastically.

I choose to ignore the comment, “Look Liz is going to be released within the next 30 minutes. You and Maria take her to your place. I’ll stop by after I catch up with Alex and see what he found out.” Michael nods and we part ways.

“So my dear perfect brother had an affair?” I hear Isabel say from the front seat. I try to ignore her. “All those times you lectured me…”

“Iz…maybe now is not the time.” Alex interrupts. Isabel sighs and nods. “We’re about 5 minutes away.”

“Thanks Alex for doing this. Jesse is out for blood even if it means convicting someone who is innocent.” I tell him.

“But Max, I’m looking at the case file, all the evidence is there.” Isabel turns and looks at me, “Are you sure Liz couldn’t have done this?”

I clench my hands together, “Isabel you’ve known Liz since I have. We’ve all been friends since high school. You honestly think Liz is capable of killing someone at all, let alone in cold blood?” I ask her, she doesn’t reply. “I know Liz didn’t do this. I may have screwed up but there is something else going on here.”

“And we’ll find out, no matter what it is, we’ll find out the truth.” Alex stated calmly. “But Max you just have to prepare yourself for WHATEVER it is we find.” He tells me. I nod understanding completely what he means. We pull up into the driveway. I see yellow police tape surrounding the house. “Do you have the key?” Alex asks. I hand it to him as the three of us walk up to the house.

Isabel starts taking pictures outside, “Max did you have a spare key under here?” She asked as she lifts the flower pot showing where a key should have been. I nod, “Where is it then?”

“Liz might have moved it, but it used to be there. We’ll have to ask her when we get back to Michaels.” Isabel nods as she takes a photo of the hidden key space. I hear the front door open.

“Iz, get a picture of this.” Alex said pointing to the door. “No forced entry like the report said but if the spare key is missing they could have used that to get in.” Alex scans the doorway, “Any reason Tess would come here and confront Liz?”

I shrug, “She knew I didn’t want to be with her and that it was a mistake. She blamed that on Liz and threatened to tell her but I had already told Liz, she knew that.” Alex nods kneeling down by the couch where a spot of blood is. “She confronted Liz outside of work and tried to tell Liz that I loved her and not Liz and that’s when the two got into a very public argument.”

“Did she know Liz was pregnant?” Alex asked. I shook my head. “Isabel can you get a shot of these blood stains, they don’t add up.”

“We just found out right after Liz’s argument with Tess or at least I did when she called to tell me.” I think back to remember that moment. I was so overwhelmed with happiness and even more determined to fix everything with Liz.

Alex catches my attention, “Max look at this blood pattern, its not common with murder. It’s as if someone purposely wanted the blood to be laid out this way.”

“Why would they do that? Just to set Liz up? Are you telling me Tess killed herself just to get even with me and frame Liz?” I start firing off questions not giving him time to answer any of them. “Why would any person do that?”

“Max, I’m not saying Tess did this but someone did, the blood pattern isn't consistent with a struggle in this room.” He signals for Isabel to take another picture of our shattered coffee table, “Look at this coffee table only half is broken but the rest is still standing kind of odd for a struggle, not to mention in the wedding photo it has blonde hairs in it but the pattern of how the glass is broke shows more of like someone punching the frame and the hairs are more scattered then if you were to slam someone’s head into it.”

Now I’m even more confused, “So did Tess set this up or…” I can’t even finish the sentence.

“I don’t know yet, but I can tell you the scene down here was definitely set up. Liz might have come home and saw the damage and then heard a noise upstairs.” Alex guesses, “I’m thinking she was planning on calling the cops but instead ran upstairs to see what the noise was instead.”

I shake my head, “That doesn’t explain why she can’t remember anything though Alex. She woke up covered in blood, holding the murder weapon.”

I hear Isabel clear her throat, I turn and see her holding a frying pan in her hand, “Not really wanting to know what goes on in your sex life brother dearest, but this frying pan might give us an idea on why Liz can’t remember.”

“She was knocked out with it.” I say confidently.

Isabel nods, “There’s specs of blood on it, we’ll have to get it to the lab to see whose it is but another weird thing, the window was pried open and shut back.”

Alex looks at her confused, “How do you know?”

“There’s nail marks on the window sill with blood mixed in, someone had trouble getting out after getting their hands dirty but they managed to because it was closed outside. There was blood outside too.” She explained holding up the samples she collected. “I also got some shots of the crime scene a few things don’t add up but I’ll have to wait until I pull these up at home.”

“So there is a good possibility someone set up my wife?” I ask them. Both of them nod in return, “But who then? Who would go to such great lengths to do this, to murder someone and then frame it on Liz?”

“What happened in court today?” She asks as she gently strokes my chest. Both spent from a few hours of unwinding we lay naked in the hotel bed together, I rub her shoulder as I close my eyes.

“She’s out on bail…for now, but there is way too much evidence against her for any jury to believe she didn’t murder Tess.” I explain to her causing her to grin. She gets up and stretches before walking to the bathroom. “What did this girl ever do to you anyways? I mean don’t get me wrong, seeing Evans is misery like this is nice, that whole family is a bunch of stuck up snobs, but how do you know her?”

She smiles as she peeks around the corner, “Oh let’s just say Elizabeth Evans and I, we go way back and this is just my little way of saying hello dear friend.” She jokes.

Jesse laughs, “I have to say, it is pretty good, I mean the case is pretty solid.”

“Of course it is. It took me years to plan this out and then to get Tess aboard was perfect. Of course once she found out the truth she didn’t want to go through with it, which made it all the more fun and realistic.” She grinned evilly.
There's no point going back to yesterday because I was a different person then...
